Preparing for the HEROES Act's OSHA Regulations

This webinar is designed to equip employers to get a head start on a likely forthcoming OSHA regulation to protect workers from occupational exposure to COVID-19 and related illnesses.

The HEROES Act (Health and Economic Recovery Omnibus Emergency Solutions Act) includes a requirement that, "Not later than 24 months after the date of enactment of this Act, the Secretary of Labor shall, pursuant to section 6 of the Occupational Safety and Health Act (29 U.S.C. 655), promulgate a final standard-(1) to protect employees" who are at occupational risk for exposure to SARS-CoV-2," also known as COVID-19, "...from occupational exposure to infectious pathogens, including novel pathogens." The legislation also requires the Department of Labor (OSHA) to develop a temporary standard within 7 days of enactment.

Should the HEROES Act become law, employers will have to comply with these new regulations. Even if it doesn't, we should still protect employees, customers, and other stakeholders from contagion as many workplaces are already doing. It is also necessary to protect continuity of operations by ensuring that, should COVID-19 ever return in either its current form or a mutated one against which any vaccines now in the pipeline will not work, it cannot workplaces to shut down as it did in the first part of 2020.

Areas Covered in the Session:

  1. Enactment of the HEROES Act will require OSHA to develop a standard for protection of employees against contagious diseases like COVID-19, in which case employers will have to meet these requirements. Employers that get a head start by planning and acting now will be in an excellent position to meet these requirements, and also protect employees and other stakeholders should COVID-19 or anything like it ever return.
  2. OSHA's "Guidance on Preparing Workplaces for COVID-19" offers a good starting point. 
  3. Create a risk register of locations and activities that could expose workers and others to COVID-19, and Involve workers in the planning process. Act to eliminate or mitigate the hazards. 
  4. Personal protective equipment (PPE) includes respirators and face masks. 
  5. Telecommuting, distance education, and distance conferencing eliminate costs associated with travel, lodging, commuting, and brick-and-mortar facilities.
