Overview

Under certain circumstances (such as convictions for patient abuse and violations of the anti-kickback statute), the Department of Health and Human Services, Office of Inspector General ("OIG") is required to exclude persons from federal healthcare programs (e.g. Medicare, Medicaid). In other circumstances,(such as civil and criminal violations of healthcare laws), the OIG has the discretion to exclude an individual from a federal healthcare program. For healthcare providers and suppliers participating in Medicare and/or Medicaid, steps must be taken to screen individuals either hired or contracted to ensure the organization is not doing business with someone who has been excluded.
This presentation will discuss the importance for exclusion screening, who must be screened, offer strategies for proper screening, and outline the potential sanctions for failing to properly screen. It will also cover some common pitfalls to avoid, and recent enforcement actions for failing to properly screen.
