26 years have passed since Canada, Mexico, and the US signed the North America Free Trade Agreement (NAFTA). One the largest free trade zones in the world, NAFTA has greatly increased trade and investment among the three nations. Recognizing that the Agreement should be updated rather than scraped, the US, Canada, Mexico have agreed to renegotiate NAFTA.

On September 30, 2018, the three nations signed the "USMCA", intending to modernize NAFTA. In consultations with the White House, on December 9, 2019, the US House of Representatives agreed to significant changes to USMCA. The revised USMCA will now go to the US Senate for ratification in early January, 2020. Mexico and Canada have also indicated their willingness to ratify the USMCA as soon as possible.

USMCA addresses recent and critical emerging issues, such as harmonization of regulatory systems, e-commerce, rules of origin, protection of intellectual property, and dispute resolution. These changes in USMCA will affect your operations and therefore, it is critical to understanding the key differences between NAFTA and the USMCA. Key highlights include the following:
  • Dispute Settlement
  • Auto Rules of Origin
  • Intellectual Property
  • Sunset Clauses
  • E-Commerce
