Severance arrangements for departing employees have so many pitfalls that even the most well-intentioned employers can be tripped up. Releases included in severance agreement, if improperly drafted, may be found enforceable, leaving employers without the protection they thought they had ensured for themselves. Some severance packages are subject to ERISA. Some employers who do not even offer severance to an employee or who do not use written severance agreements, find themselves ordered by a court to provide severance pay or benefits.
